1. General Shipping Information
GunsBay facilitates transactions between buyers and sellers by providing a shipping process that complies with federal requirements for firearm transfers. As a Federal Firearms Licensee (FFL), GunsBay generates shipping labels and ensures that firearms are transferred only between licensed FFL holders. However, it is the responsibility of both buyers and sellers to comply with all federal, state, and local firearm regulations.
2. Shipping Process
- All firearms must be shipped from and delivered to a valid FFL holder.
- Once a buyer completes a purchase, GunsBay will generate a shipping label for the seller to use.
- Sellers must ensure all shipments adhere to ATF regulations and provide tracking information.
3. Returns and Transfers
If a firearm is returned from the buyer’s designated FFL for any reason (such as a failed background check or legal restrictions), the return process will be as follows:
- The firearm will be shipped to GunsBay’s FFL first. Since GunsBay generates the shipping label, all returned firearms must be sent to our FFL before being forwarded to the seller’s designated FFL.
- GunsBay will then ship the firearm to the seller’s FFL. Firearms will only be shipped back to the seller’s chosen FFL—no third-party transfers or alternative buyers.
- The buyer may be responsible for return shipping fees. If the return is due to a failed background check or another buyer-related issue, the buyer may be charged for shipping costs.
- The seller must pass a background check before retrieving the returned firearm from their FFL.
4. Seller Responsibilities
- Ensure that the firearm is properly packaged and shipped using the GunsBay-provided label.
- Confirm the receiving FFL’s information is accurate before shipment.
- Maintain compliance with all federal, state, and local firearm laws.
- If a firearm is returned, the seller must successfully complete a background check before taking possession of the returned firearm.
5. Buyer Responsibilities
- Select a valid FFL for the firearm transfer.
- Ensure they meet all legal requirements to receive the firearm.
- Work with the selected FFL to complete necessary background checks and paperwork.
- Be aware that they may be responsible for return shipping costs if a firearm is sent back due to a failed background check or other buyer-related issues.
6. Shipping Restrictions
- GunsBay does not ship firearms to jurisdictions where they are prohibited by law.
- It is the buyer’s responsibility to confirm legal eligibility before purchasing.
- Certain states or localities may impose additional restrictions on firearm shipments.
